The US Department of Commerce in March imposed countervailing duties and anti-dumping tariffs from 2.9 to 4.73 percent on solar panels made in China, charging that the Chinese government was illegally subsidizing their manufacture under World Trade Organization rules and that Chinese solar module manufacturer was "dumping" them in the US at below-market prices. The Coalition for American Solar Manufacturing, CASM, which accused the Obama administration over a loophole in tariffs announced last year on Chinese-made solar panels and cells, saying a deliberately included exemption in the penalties allows some imports to continue, harming the domestic industry. They even had lobbied the Obama administration to impose the tariffs, is asking the US Court of International Trade to close the loophole.
Solar Company CEO Says Tariffs Will Hurt Industry
In a recent opinion piece written by Tom Gutierrez, CEO of GT Advanced Technologies, Gutierrez said the solar panel tariffs are highly problematic. According to his letter, published Oct. 3 on the Renewable Energy World website, he said members of the U.S. solar industry are seriously concerned about the "misguided nature of government-imposed solar panel ‘dumping’ tariffs."
"We hope ITC (U.S. International Trade Commission) officials are willing to analyze the real impacts of these troubling tariffs, and elect instead to let companies compete in the global marketplace as they should: on their own two feet," Gutierrez wrote.
German-owned SolarWorld first petitioned the ITC for an investigation into China’s trade practices, while several U.S. solar companies have warned against imposing tariffs, he said.
"The reality remains that U.S.-imposed tariffs have done little to protect SolarWorld and other companies that fundamentally can’t compete on their own," Gutierrez wrote. "Instead, it has antagonized a strategic trade partner who is now threatening to impose their own tariffs on imported polysilicon material, which would hurt U.S. producers."
According to Gutierrez, the situation has introduced additional cost into the equation for solar power, which he said is counterproductive to the continued growth and stability of an industry.
Excuses for United States to Protect Their Local Enterprises Besides wholesale solar panel, CASM is also appealing Commerce's decision not to investigate Chinese subsidies on aluminum extrusions and rolled glass, as well as it’s imposing of separate, lowers duty rates for several Chinese panel makers.
CASM said those companies should not have qualified for lower rates because they failed to provide sufficient evidence that they are not owned or controlled by the Chinese government.
Superpower as United States is willing to say Ok for China's natural resources, cheap labor in China, but not pleased with the high-value-added products sale in the United States. When one day they cannot stop Chinese technology, patents knock their door, the national security has become the best excuse. In the future, United Stated will have more and more of course excuse stopping Chinese enterprises for protecting their own companies.
